Any order implies automatically full and whole acceptance by our customer of these conditions and our going rates, of which he admits having taken knowledge. All other conditions contrary or different from our general terms, which could be stipulated by the customer before or after its order are, consequently, reputed not written, except preliminary and written acceptance our Company.

2 - Applicable law - Litigations :
The Orders are subject to French law. Contractual information are presented in French language and the sale offered products are in conformity with the French regulation. If necessary, it is to the foreign customer to check from local authorities the use possibilities of the product which he plans to order; the responsibility of GESTOR S.A. can not be committed in the event of non-observance of the regulation of a foreign country where the product is delivered.
In the event of litigation, the Bankruptcy court of Rochefort is the only qualified, whatever the mode of payment accepted, even in the event of plurality of defendants.

3 - Presentation of the products :
The characteristics of the offered products to sale are presented in their respective pages, that is to say “Aquascent, perfumes for Swimming pool and Spa water ” and “the Authentic Eau de Cologne of Emperor Napoleon the 1st in Saint Elena”.
The photographs do not enter the contractual field. The responsibility for GESTOR S.A. cannot be committed if errors were introduced there.
All the texts and images presented on the sites www.gestorfrance.com, www.historical-perfumes.com, www.parfums-historiques.com & www.aquascent.com are reserved, worldly, under the royalties and of intellectual property; their reproduction, even partial is strictly prohibited.

4 - Period of validity of the sales offers :
The products are offered for sale until exhaustion of stock. In the event of ordering of a product become inalienable, the customer will be informed of this unavailability, as soon as possible, by e-mail or mail.

5 - Price of the products :
The “PURCHASE ORDER” heading indicates the prices in euros all taxes included, except costs carriage. The amount of the VAT is included in the indicated price and the carriage costs appear on the screen at the end of the selection of the various products by the customer.
GESTOR S.A. reserves the right to modify its prices constantly but the ordered products are charged at the price during the entering up of the order.

6 - Order :
The customer validates his order when he activates the bond “Credit card payment” at bottom of the 2nd page of “Purchase order” then carries out the credit card payment on the payment protected website of the CIO-CIC Bank; he then accepts the process of order and the present conditions of sale.
GESTOR S.A. confirms the order by e-mail; this confirmation sums up all the elements of the order.
GESTOR S.A. has information technology means intended to more easily manage the forwarding and the follow-up of the orders.
Recorded information constitutes the proof of the nature, the contents and the date of order and is reserved for the use of the services concerned. They can be communicated only to the following recipients: service forwarding and business service of GESTOR S.A. and its partners proposing products for sale on the www.gestorfrance.com site.
In accordance with articles 39 and according to law n° 78-17 of January 6, 1978 relating to information technology, files and freedoms, any person can obtain communication and, if necessary, correction or suppression of information relating to himself, by contacting the Customer service department +33 (0) 5 46 84 84 83.

7 - Payment :
The payment is done by bank card. The GESTOR S.A.site leads automatically to a payment platform, which is protected and encrypted, that of the CIC-CIO Bank. The payment is carried out directly between the the customer’s bank and the CIC-CIO Bank.
GESTOR S.A. only receives information informing him that its account was credited with a sum corresponding to a numbered order X. GESTOR S.A. does not carry out the transaction and from this fact never receives any information relating to the credit card of the customer or all other banking coordinates.

8 - Delay of payment :
According to article L. 441-6 of commercial law, penalties for delay are exigible the day following the date from payment appearing on the invoice if the sums due are paid after this date. The amount of these penalties is of once and half time the legal rate of interest.

9 - Delivery :
The delivery of the available products is, for Metropolitan France, of approximately 2 business days starting from the day of the order.
The risk of transport is supported by the purchaser who, in the event of damage of delivery or lack, will specify his reserves on the delivery order and will confirm them, in the three days of the delivery, by registered mail with return receipt addressed to the conveyor.

11 - Data confidentiality :
The personal data provided by the customer are not diffused to a third party; it is, unless express opposition of the customer, are integrated in the customers file of GESTOR S.A.
In accordance with law 78-17 of January 6, 1978, the customer constantly has the right to access and correct. To exert this right, the customer needs to contact the Customer Service Department of GESTOR S.A.
